Hi, Folks:
Please read this message from (who lives on Ft. Harrods Drive) regarding a reckless, speeding driver. I have suggested calling the police to get them to stake out Ft. Harrods and possibly ticket this person.
Keep an eye out for him/her
"Every morning between 7:15 and 7:30, a black BMW SUV comes screaming into the neighborhood off Harrodsburg Rd. This person runs stop signs, tailgates other cars, and then gets up to 60 mph on Fort Harrods Dr (or Lyon if it’s blocked) once he’s just about run everybody off the road. I’ve watched him or her do it 4 or 5 times over the last couple of months. I saw it yesterday and today. Ultimately whoever it is ends up at Dunbar. I would like to report this to the police, but I’m not sure one person’s word will be enough to get anybody over here to catch him (or her). Has anybody else seen this or said anything about it? "

Good evening! I wanted to make the neighborhood association aware of an incident that occurred early this morning on Gondola Dr. My wife and I were awakened at 3:47 AM to basnging on our front door. The man at the door banged on the door a second time and I got up to go see who was at the door. This is Patricia Wheatley & my husband and I live on Snaffle Road.
I have been thinking about doing a women’s book study at my house, or the library for those in Harrods Hill.
Are we able to post this special interest group even if it’s a Christian based book, like studying Philippians 4:8 or, does it need to be other forms of books, for example, Henry Winklers new book, being Henry?

Hi, Folks:
Our HHNA membership meeting on Sunday, January 7th was well-attended, informative, and productive.
Our Councilman, Dave Sevigny, updated us on the Ft. Harrods Drive widening project, slated to happen this year. This initiative should alleviate some of the traffic problems caused by many cars using the Ft. Harrods/Harrodsburg Rd. intersection when exiting our neighborhood.
We also discussed the biking-walking trails slated to be built alongside Harrodsburg Road (don't have details yet), STRs/Airbnbs, ADUs (aka "Granny Flats"), and the storm sewer project currently underway on Ft. Harrods Drive.
Dave Sevigny brought with him two city planners, Chris Taylor and Hal Bailey, who answered questions and shared information about a variety of city initiatives.
We elected our slate of officers for 2024, as follows:
President. Mary Beth Griffith
Vice Pres Kyna Koch '
Treasurer Phil Greasley
Secretary Jenny Poole
Social Cindy Sterne

On my daily walk yesterday, I saw the Harrods Hill Park's playground being repaired. The slide replacements finally arrived and were being installed-- hooray!
Councilman Sevigny also informed us at the meeting we will soon have a porta-potty back at the park but it will be placed upon a concrete base which will make it difficult (I'm hoping impossible) to flip over, as has happened umpteen times.
Soon you will receive HHNA membership materials in the mail and this year it is especially important for you to join.
As STRs/Airbnbs multiply, our neighborhood may have more need of paid legal assistance to help us regulate them.
Your small $40 membership fee also helps us maintain the front entrance, sponsor social events, participate in neighborhood grants, and do many other things to keep our neighborhood the lovely place it is.
Attached to this email you'll find information regarding an artistic opportunity to paint a storm drain, We have LOTS of creative folks in our neighborhood so please give this some consideration. We placed this on the Homepage on the Marquee for you.

Please bring your checkbook so you can go ahead and submit your 2024 membership.
ALSO- Our social chair, Melissa Lucante Wolfe, has decided to "retire" from her position after doing a lovely job for HHNA, planning our Easter activities, July 4th Parade, etc.
Are any of you interested in taking over the position?
If you'd like to share the job with a friend, that would be great, too.
Melissa (and other former social chairs) are available and happy to help you figure out the job, though it isn't terribly difficult)

Please read this message from our planning and zoning chairman, Walt Gaffield:
The passage of Lexington's short-term rental (STR) ordinance in July of this year has put our neighborhood under increased risk that new neighbors could be groups of people who stay for a few days and then leave. The average stay for people in Airbnbs and VRBOs in Lexington is just 2.5 days, and the estimated number of STRs in Lexington is 1,250. A four-bedroom house with a host can rent to up to twelve people without notice to neighbors or a hearing. An unhosted STR must provide notice and have a hearing before the Board of Adjustment in order to become an STR with a conditional use permit.
It is HHNA's position (based on legal advice) that STRs are prohibited by our deed restrictions, whether hosted or unhosted. The Restrictions are in your neighborhood directory and on the Harrods Hill website--https://harrodshill.weebly.com. An application for a conditional use permit (CUP) has already been filed for a house on Snaffle Road and then withdrawn. Should a short-term rental appear next door, or if you receive notice that someone has applied for one, please contact Harrods Hill Neighborhood Association, and we can discuss how to enforce deed restrictions.
1. Article 5 of the restrictions indicates they are still in effect.
2. Article 6 indicates that, "ANY lot owner at any time may enforce the restrictions and covenants herein contained by appropriate legal procedure."
3. Article 1 states that, ALL property . . . shall be used for single family residential purposes only." The associatiobn on the advice of counsel believes that a short- term rental property (like Airbnb or VRBO) is a commercial use, not a residential one.
4. Article 9 states that, "NO noxious or offensive trade or activity shall be carried on upon any lot nor shall anything be done thereon which may be or become an annoyance or a nuisance to the neighborhood."
5. Article 11 would prevent people from living in garages and backyards etc.
I think it's important to pay attention if we intend to keep residences from becoming hotel-like with tourists living next door for very short durations. If anyone is selling a house in the neighborhood they should provide a copy of the deed restrictions to the buyer.

Yard Sale this Saturday
Quick reminder that this Saturday is the fall yard sale here in Harrods Hill.
It's a great opportunity to clean out your attic, garage, closets, junk drawers, etc.
The weather forecast looks good right now, so happy selling!!
Mill Ridge Farm
As I recently wrote, there was a possibility that all of Mill Ridge Farm was going to be added to the Urban Services Area, which would have meant 900 acres surrounding Dunbar High School and contiguous to other famous horse farms would have been turned into a very large subdivision/development. This could have had a negative impact on Harrods Hill in several ways, including potential overcrowding of our schools, traffic problems, inadequate infrastructure, etc.
The committee charged with deciding what to include in the Urban Service Boundary met yesterday and decided to include only the portion of Mill Ridge that is INSIDE of Man o War Blvd, bordering Parkers Mill Road. Even though development in that area might have some negative effects, they won't. be nearly as great as developing all of MIll Ridge Farm would have been.

Last night family members from the Bell and Headley families asked a committee of the Urban County Government to expand the Urban Services Boundary to include Mill Ridge Farm inside the boundary. Mill Ridge is the farm on both sides of Parkers Mill Road and adjacent to Paul Laurence Dunbar High School. The Urban County Council has asked the Committee to select from 2,700 to 5,000 acres of land outside of the Boundary for development, and choices have narrowed to five possible sites around Lexington with two of them including parts of Mill Ridge.
I will be providing more information. This involves planning rather than immediate action, so even if selected, this will not happen this year or next. We may need to activate our ad hoc education and planning committees. My primary concern is the impact of new residential development on school redistricting. One of the speakers for the farm last night said that a school was available. The only one close is Rosa Parks. Obviously we need to make a case for new development not displacing existing neighborhoods from Rosa Parks if the Committee and Council Select Mill Ridge. Additionally, we should talk with the FCPS folks about the possibility of a new elementary school within the newly developed area. With Planning and the Council, we need to suggest that Mill Ridge would not be a great area for inclusion inside the boundary without addressing infrastructure needs (like schools and roads).

Dear Harrods Hill Neighbors,
I (Walt Gaffield) just learned that Transportation Planning for the Urban County Government associated with State Highway District 7 is considering a new project for a bicycle trail on Harrodsburg Road that would harm our neighborhood significantly. The project if it doesn't change conceptually could have the following impact:
1. All of the pine trees and honeysuckle along Harrodsburg Road adjacent to Nevius Road would be removed. Honeysuckle is an invasive species. We don't know of any plans to replace either the trees or the honeysuckle with native plants..
2. We would lose our front entrance at Fort Harrods Drive without reimbursement.
3. No plans exist at this time for providing soundproofing between the backyards on Nevius and Harrodsburg. Simply replacing the rundown wooden fence behind the pine trees would be inadequate and unacceptable in my opinion.
One would think that the bicycle trail would be on the other side of Harrodsburg Road outside of New Circle because it would have little impact on commercial property there. Bicyclists wanting to visit Beaumont Centre could cross at the double diamond intersection with new Circle Road and easily get to Palomar Centre through the neighborhood. Similarly, bicyclists coming from the other direction could cross at Fountains of Palomar or Man O' War boulevard to get to both retail developments on our side.
We have "F" rated intersections during the afternoon rush hour (approximately 4:00 to 6:30) at Alexandria Drive/Pasadena, New Circle Road, Beaumont Center Parkway, Fort Harrods Drive, and Man O' War Boulevard, and one might also think that using land for a bicycle path might not be a great idea. Planners hope for a significant increase in bicycle use to reduce traffic and are very, very optimistic based on current realities.

One would think that the bicycle trail would be on the other side of Harrodsburg Road outside of New Circle because it would have little impact on commercial property there. Bicyclists wanting to visit Beaumont Centre could cross at the double diamond intersection with new Circle Road and easily get to Palomar Centre through the neighborhood. Similarly, bicyclists coming from the other direction could cross at Fountains of Palomar or Man O' War boulevard to get to both retail developments on our side.
We have "F" rated intersections during the afternoon rush hour (approximately 4:00 to 6:30) at Alexandria Drive/Pasadena, New Circle Road, Beaumont Center Parkway, Fort Harrods Drive, and Man O' War Boulevard, and one might also think that using land for a bicycle path might not be a great idea. Planners hope for a significant increase in bicycle use to reduce traffic and are very, very optimistic based on current realities.

I wanted to make everyone aware of the hazard street tree (cost-share) program that is open until November 1, 2023.
The city offers a financial incentive program to remove and replace trees in the public right-of-way easement. The property must be owner-occupied. The program provides a 50% reimbursement to eligible property owners for the cost of tree removal, stump grinding, and planting a new tree to replace the one being removed. There are provisions for 100% funding for low-income assistance for those who qualify. Participation is strictly voluntary, and funding is limited to a first-come, first-served basis.
This is a GREAT deal and please let your neighbors know about it. Some neighborhoods with problematic trees (like Bradford Pears) have done big projects of 30-40 replacement trees.

They will be presenting historical research grounded in archival documents such as maps, deeds, government policies, and marketing materials related to numerous Lexington neighborhoods. Their goal is to share knowledge as a basis for addressing longstanding injustice. You will not be able to get this information in one place anywhere else. As many of you know, someone has been hanging out at Harrods Hill Park and vandalizing the playground (setting off fireworks inside the tunnel slides, e.g.)
It's frustrating that some folks have nothing better to do than to destroy public property.
We have asked the city for additional police patrols, installation of security cameras, and speedy repairs.
See below the latest info provided by the city to our councilman Dave Sevigny.

Our Certified Playground Safety Inspector checked on the condition of the slide prior to closing it off for use.
It has burnt areas that may injure a user. We did file a claim and received a quote of $11,700 for two slides and the tunnel.
Park Patrol roving shift had Harrods Hill on their patrol, but of course that isn’t 24/7 type of coverage.
We do not have an estimate of timeframe from the playground distributor yet.

I think we broke the record for number of participants.
Everyone's decorations were superb.
Speaking of-- a well-decorated small blue car (the kind with the extended handle for pushing) was left behind at the tennis court parking lot.
If it is yours, please go claim it!
One more point:
There have been several incidents of fireworks/vandalism at our Harrods Hill Park playground recently.
We have asked for additional police patrols in that area but if you see destructive behavior happening there, please call the police non-emergency number:

I've had a report of some shenanigans at the Harrods Hill Park where someone shot off fireworks in and around the playground equipment leaving debris, ash, trash, etc.

As always, our parade will begin at the corner of Ft. Harrods and Mantilla at 10:00 a.m. and will proceed to the tennis court parking lot.
There will be a fire truck, popsicles for everyone and prizes for best decorations.
So get busy decorating those bicycles, tricycles, big wheels, wagons, etc.
Also, as usual, the Harrods Hill pool will be open to all Harrods Hill residents on July 4th.
There will be live music and a potluck dinner at around 5:00 p.m. with chicken strips and wings provided.

Dear Neighbors,
The Planning Commission recommended approval and will return the short-term rental ordinance to the Urban County Council (which drafted it) on June 5. There are now over 1,000 short-term rental properties in Lexington and not enough houses for people who live here. Several of the Planning Commission changes to the document are notable:
1. Council had recommended that short-term rentals (STRs) have a maximum occupancy of 12. Planning staff recommended a reduction to 8, and the Planning Commission overruled the staff recommendation at the urging of Council Members. The Planning Commission overruled the staff recommendation and moved occupancy back to 12.
2. The Council version had recommended that the Board of Adjustment look at STRs within 1,000 feet in making decisions about a new STR. The Planning Commission changed it to looking in the "proximity."
3. The staff and Commission added two important paragraphs to the Ordinance on what happens to existing short-term rentals. Citing Section 4-7 of Lexington's zoning ordinance, the Commission found that an existing STR is a "principal permitted use" under current regulations and would automatically convert from being a nonconforming use to a conforming conditional use upon passage of the new ordinance.
Fayette County Neighborhood Council (FCNC) has made the following recommendations to the Council on the newly revised Ordinance:
1. Allow new hosted short-term rental properties with an occupancy of 4 or less to receive a license without a Board of Adjustment hearing.
2. Reduce the calculation of "capacity" of STRs from 2 per bedroom plus 4 on the floor to 2 per bedroom in dwellings with 4 or fewer bedrooms. The draft ordinance as written is designed to accommodate mega STRs rather than neighborhood STRs.
3. Require that conditional use STRs be a minimum of 600 feet apart, boundary to boundary, copying Louisville's short-term rental standard. This would be simple and easily enforced. Having the BOA look at other STRs in the vicinity--a very fuzzy standard--is going to be a problem for neighborhoods and will help real estate investors with legal counsel.
4. Sunset conditional use permits when an STR is sold or transferred, so it can more readily return to residential use.
5. Change BOA and Division of Revenue consideration of nuisance citations in the vicinity to also include "recorded or attested citizen complaints." Citations are rare in Lexington.
6. FCNC has asked questions about the legality of the new part of the ordinance dealing with Section 4-7 of Lexington's zoning ordinance and nonconforming uses but has yet to receive an answer.
The Council potentially could consider the STR ordinance in a work session scheduled on June 13 where it will not take public comment. You may reach council members with your thoughts on the ordinance by sending an email to [email protected]. A committee of the Louisville Metro Council recently recommended that Louisville stop accepting new License applications for STRs for 6 months because of numerous complaints from neighborhoods. Covington has had similar problems.
Please advise Council of your thoughts now.

I've had a report of vandalism in our neighborhood. Someone went through a trash can and left garbage strewn through several yards. Then, the vandals went through the car of the homeowner. I don't think they stole anything but still, not cool (to say the least)
Stay alert and have a wonderful long weekend!

I hope everyone had a happy Easter and that you were able to spend time with those you love.
With a busy month in the rearview mirror, there's an even busier one ahead. While Council may currently be on Spring Recess, we are busy preparing for what lies ahead. The two biggest items are the Goals & Objectives for Imagine Lexington 2045 and the FY24 Budget, both of which will take a considerable amount of time and effort. We will dive a little deeper into Goals & Objectives below and next month we will provide an update on the Mayor's Proposed Budget, which comes out on April 18th at 3 p.m. You can find her address and proposed budget online on afternoon of the 18th.

Attend a meeting to discuss what we can do at 6:30 on Thursday February 16th at Palomar Hills Clubhouse, 4025 Palmetto Drive.

Attend the Planning Commission Meeting on Thursday February 23rd at 1:30 PM.
It will be held in the Council Chambers in the Main Govt. Building at 200 East Main St. Parking is in the Helix Garage at 150 East Main. You will need to go down to ground level after parking as the Garage is not connected to 200 East Main. I know this is a VERY INCONVENIENT time for most of us. You do not have to speak but if you chose to do so you will have 3 minutes. Your presence alone will speak volumes.

Attend the Planning Commission Meeting on Thursday February 23rd at 1:30 PM.
It will be held in the Council Chambers in the Main Govt. Building at 200 East Main St. Parking is in the Helix Garage at 150 East Main. You will need to go down to ground level after parking as the Garage is not connected to 200 East Main. I know this is a VERY INCONVENIENT time for most of us. You do not have to speak but if you chose to do so you will have 3 minutes. Your presence alone will speak volumes.
Sign a petition located on the front porch of 1248 Raeford Lane. Please be sure not to sign multiple petitions as there are several groups who have circulated them.
The local ordinance governing the Planning Commission’s decision is Article 25-Telecomunication Towers of the Municode Code Library for Lexington, KY.

First I want to thank Palomar Hills for graciously hosting our meeting. Thank you,Walter Gaffield,f or sharing your extensive knowledge with us. We are planning to meet again next Thursday at Palomar Hills Clubhouse to share findings/research and plan for Feb 23rd. Hopefully you will be able to assist with a committee listed below before that meeting.
PETITION:Yan Ling Newman wanted to let you know that a petition is available to sign on the porch at 1248 Raeford Lane. There are several petitions circulating. Please be sure to sign only one.
ATTEND PLANNING MEETING ON FEB 23:Please do everything in your power to attend the meeting at 1:30 on Feb 23rd and fill your car with friends, neighbors and family to attend. This will have tremendous impact. I forwarded an email yesterday from Autumn Goderwis which details the format of the meeting. I also forwarded Article 25. Please email or text me if you need these.
WE MUST FOCUS OUR RESPONSE AND REMAIN POLITE: Walter reminded us that ARTICLE 25 (1-6) of the LFUCG Ordinance governs precisely what will and will not be considered in the Planning Commission's decision on the cell tower. You are free to go on the record with other issues (such as impact on human health) in your 3 minutes, but your presentation will not factor into their official decision. Reviewing the 207 page application as it relates to Article 25 is also valuable.

The information below is from Councilman Sevigny concerning the Cell Tower proposal.
An application was submitted to LFUCG for the construction of a wireless communications facility, which includes a 125-foot-tall monopole tower and the associated ground equipment within a 60' x 60' fenced and a landscaped ground compound at 2190 Ft. Harrods Drive. If you are receiving this email, you requested more information or live in a neighboring area, and we want to make sure you are informed.
Last week, Councilmember Whitney Baxter and I hosted a community meeting at the Beaumont Branch Library where LFUCG Planning staff presented information on the application and answered everyone's questions. From that meeting came the desire to form a united AND organized front when this is presented to the Planning Commission on Thurs., Feb. 23 at 1:30 p.m. in Council Chamber.
Joyce Arvin volunteered to take the lead on these organizational efforts (help from other community members will be accepted as she also works full time!). If you know someone who was unable to attend our community meeting but also know they want to be a part of the opposition, please have them provide us with their contact information so they can be added to the group discussion.
For those unable to take part in more meetings but want to have their voice heard, you may send a letter to Planning via [email protected] or through the mail to the address below, and your letter will be presented to the Planning Commission and entered as evidence for the record.

4. Can we see a copy of the lease agreement? The lease agreement is in their application, but we pulled it out to make it easier to find/view.
5. Who can we contact to ask questions about the application, historic concerns, and the company or companies that will be utilizing this? We made a contact sheet with the information of the applicant's attorneys, Public Service Commission, LFUCG Historic Preservationist, and our Planning staff that was in attendance. - This item does not come before Council, only the Planning Commission
- Planning Commission meetings can last for many hours. Please be prepared for that on 2/23.
- The Planning Commission can only take certain factors into consideration while making a decision on whether to approve and are guided by city ordinance and state statutes.
- Each person wishing to speak will have 3 minutes to do so. Repetitive comments are discouraged and "irrelevant" comments will not be allowed (i.e. environmental and health factors as the Planning Commission will not be allowed to take those things into consideration here).

HHNA membership had a productive meeting yesterday/Sunday January 29th at the YMCA.
Dave Sevigny, our new council member, presented a very informative power point on issues affecting our city and our district.
